WORK EXPERIENCE PRIOR TO BAR ADMISSION:

Prior to and while pursuing his undergraduate education as a part-time evening student, Mr. DeMarco was employed in the construction industry as a laborer, carpenter, truck driver, and equipment operator, and was a member of the International Laborer’s Union of North America Local 455. He was also employed in the trucking/freight industry as a dock worker and driver, and was a member the International Brotherhood of Teamsters Local 443. In the construction field, Mr. DeMarco acquired knowledge and experience with all phases of commercial construction and residential construction, from the beginning to end of the project. This real-life construction work experience gives Mr. DeMarco an understanding of life “on the job” that only those who have worked in the field can truly appreciate, and further provides a firm foundation for construction litigation and dispute resolution matters.

LEGAL BACKGROUND AND AREAS OF PRACTICE:

Mr. DeMarco was admitted to the practice of law in the State of Connecticut in 1984, where he managed his own law firm and practiced as a sole practitioner until 2006, at which time he relocated to Naples, Florida. Attorney DeMarco was admitted to the Florida Bar in 2007; his areas of practice include:

Commercial and residential building construction matters, providing representation for owners, lenders, community associations, material suppliers, contractors and subcontractors, throughout all phases of a project, such as contract negotiations and drafting; billing and materials related disputes, Florida Construction Lien Law compliance; breach of contract claims; defective construction claims, breach of warranty claims, priority of lien claims, and construction lien foreclosures. Attorney DeMarco suggests a collaborative initial approach intended to reinstate and/or promote communications in order to create an opportunity for the parties to reach their own resolution where possible, including a written settlement agreement, before initiating legal proceedings. If settlement efforts are not successful, Attorney DeMarco is experienced with related litigation, arbitration, mediation, and/or other alternate dispute resolution.

Homeowners’ Association and Condominium Association matters, providing representation for owners, Associations, and first mortgage lenders, in matters such as Board of Directors practices and authority disputes; disputes involving interpretation of Governing Documents, Architectural Standards, and other controlling documents; assessment lien issues; fines and fining procedure issues; rules violations issues; membership rights and privileges disputes; disputes related to amendment of documents, priority of liens, and amount of assessments; assessment lien foreclosures; fine lien foreclosures, and other related matters. Mr. DeMarco has significant experience in this area of law, as an attorney, an association member, as a Director on the Board of Directors of both condominium associations and homeowners’ associations, and is a licensed Community Association Manager.

General creditor representation and creditor representation in Bankruptcy Chapters 7, 11, and 13 for matters such as secured and unsecured loan transactions and documentation; litigation and enforcement of loan documents including foreclosures of real estate mortgages; construction lien foreclosures, judgment lien foreclosures, and foreclosures of security interests in personal property; post judgment remedies; real and personal property valuation; deficiency judgment claims; loan workouts, short sales, and non-foreclosure methods of secured debt resolution.

Real estate contract disputes and real property related litigation, such as contract interpretation disputes; inspection issues and undisclosed latent defects; contingency clause disputes; termination of contracts and claims for returns of deposit; agent commission disputes; breach of contract and specific performance litigation; property valuation, boundary disputes, survey matters, claims of easements, adverse possession, and questions related to title.

General business and commercial litigation matters.

Commercial landlord-tenant matters, including lease negotiations and drafting, lease related disputes, and eviction actions.
